Foreign workers in Malaysia who possess an Employment Pass must be informed of the recent regulations affecting their residency in the country. The Malaysian Immigration Department has required that employers who wish to modify Employment Pass categories for foreign nationals submit a ‘change of category letter’ during the application approval process.
The newly implemented procedure necessitates that employers or companies cancel the existing Employment Pass when seeking a change of category (Category 1, 2, or 3). Furthermore, starting from January 1, 2025, it will be mandatory for employers or companies to provide a ‘change of category letter’ at the application approval stage.
The Employment Pass (EP) serves as a work permit that allows expatriates to be employed by an organization in Malaysia, with a validity linked to the employment contract (up to 60 months). Holders of the Employment Pass may also apply for a Dependant Pass for their spouse and children under the age of 18.
It is important to note that foreign workers are permitted to work solely for the company specified in their Employment Pass. Should they wish to change employers, they must submit a new application.
Prior to applying, foreign workers should verify the eligibility of their prospective employer to apply for an Expatriate Employment Pass. Approval from the Expatriate Committee (EC) or relevant authorities is required for foreign talent to occupy a position before the Immigration Department of Malaysia can issue an expatriate Employment Pass.
